A Court of Appeal decision has found that Special Education 2000 (the policy which relates to the delivery of Special Education in schools) does not breach the rights of...




children with special needs under the Education Act.  It did, however, find that the 1998 decision to disestablish Special Education units did not comply with the Education Act, which required locality-by-locality comparison of existing and special resources.  This issue has been referred back to the High Court to see what remedy, if any, should be made.
